1. Acceptance of Terms

By accessing and using CareerPing ("the Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is governed by India's Digital Personal Data Protection (DPDP) Act, 2023. If you do not agree to these Terms, please do not use the Service.

2. Data Protection and Consent

By using the Service, you consent to the collection, processing, and storage of your personal data as described in our Privacy Policy, in compliance with the DPDP Act, 2023. You acknowledge that you have read, understood, and agreed to our data practices. You may withdraw your consent at any time through your account settings.

3. Subscription Plans and Pricing

CareerPing offers various subscription plans including Free, Basic, Pro, and Enterprise tiers. Each plan has specific features, usage limits, and pricing as outlined on our pricing page. By subscribing to a paid plan, you agree to pay the applicable fees for your chosen plan.

4. Usage Limits

Each subscription plan has specific usage limits for AI messages, resume analyses, and interview sessions. These limits reset monthly. Exceeding your plan limits may result in additional charges or service suspension until you upgrade to a higher tier or the next billing cycle begins.

5. Payment and Billing

All payments are processed through Stripe. By subscribing to a paid plan, you authorize CareerPing to charge your payment method on a recurring basis (monthly or yearly) until you cancel your subscription. You agree to provide accurate and complete payment information.

6. Cancellation and Refunds

You may cancel your subscription at any time through your account settings or by contacting support. Cancellations will take effect at the end of the current billing period. Refunds are handled on a case-by-case basis. Please refer to our Refund Policy for more details.

7. User Responsibilities

You are responsible for maintaining the confidentiality of your account credentials. You agree not to use the Service for any illegal or unauthorized purpose. You must not attempt to gain unauthorized access to the Service or its related systems. You agree to provide accurate and truthful information when creating your account.

8. Data Accuracy and Updates

Under the DPDP Act, 2023, you are responsible for ensuring that your personal data provided to us is accurate and up-to-date. You must promptly update your information if it changes. You can exercise your rights to access, correct, or delete your data through your account settings or by contacting our Data Protection Officer.

9. Intellectual Property

All content, features, and functionality of the Service are owned by CareerPing and are protected by international copyright, trademark, and other intellectual property laws. You may not reproduce, modify, or distribute any content from the Service without explicit written permission.

10. Privacy and Data Protection

Your use of the Service is governed by our Privacy Policy, which describes how we collect, use, and protect your personal information in compliance with the DPDP Act, 2023. Please review our Privacy Policy carefully to understand your rights as a Data Principal.

11. Disclaimer of Warranties

The Service is provided "as is" without any warranties, express or implied. CareerPing does not guarantee that the Service will be uninterrupted, secure, or error-free. Career advice provided by AI should be used as guidance and not as professional career counseling.

12. Limitation of Liability

In no event shall CareerPing be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to data breaches in accordance with the DPDP Act, 2023 provisions.

13. Grievance Redressal

If you have any grievances regarding data processing or violations of your rights under the DPDP Act, 2023, you may contact our Data Protection Officer at dpo@careerping.co.in. We will acknowledge your grievance within 48 hours and resolve it within 30 days as per DPDP Act requirements.

14. Changes to Terms

CareerPing reserves the right to modify these Terms at any time to reflect changes in our practices or applicable law, including the DPDP Act, 2023. We will notify users of significant changes via email or through the Service at least 30 days before the effective date. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.
